When a serious new American opera is embraced by audiences, its a rare and encouraging achievement. Since its premiere at the San Francisco Opera in the fall of 2000, Dead Man Walking, with music by Jake Heggie and a libretto by Terrence McNally, has been picked up by companies across the country. The elaborate staging presented by the New York City Opera on Friday night and directed by Leonard Foglia is a co-production with the Cincinnati Opera, Austin Lyric Opera, Michigan Opera Theater, Pittsburgh Opera, Baltimore Opera and Opera Pacific. As at the premiere, the audience responded with an enthusiastic standing ovation. That said, when the score to a new American opera is as uneven as Mr. Heggies, the popularity of the work is a more problematic matter. The creators set themselves a daunting task in making an opera out of the compelling, self-effacing 1993 book by Sister Helen Prejean about her work as spiritual adviser to death row inmates, also the source for the devastating and powerfully restrained 1995 film directed by Tim Robbins. Lawsuit Is Filed Over The WALKING DEAD
The Walking Dead series has been a dominating presence on our graphic books best-seller lists for some time - the most recent trade paperback, Vol. 15, is still No. 1 on that list for this week - but where some of the money from its sales should go is now in dispute. The series writer and creator Robert Kirkmans original collaborator, the artist Tony Moore, filed a lawsuit in Los Angeles Superior Court on Thursday. Mr. Moore claims that Mr. Kirkman has not shared the previously agreed-upon amount of royalty or other payments for the properties they created together, which include The Walking Dead, Brit and Battle Pope. The complaint also alleges that, in 2005, Mr. Kirkman fraudulently persuaded Mr. Moore to assign his rights over to a limited liability corporation controlled by Mr. Kirkman, and that he has not provided access to profit statements for the properties. The lawsuit is ridiculous, Mr. Kirkman said. We each had legal representation seven years ago, and now he is violating the same contract he initiated and approved, and he wants to misrepresent the fees he was paid and continues to be paid for the work he was hired to do. Tony regularly receives payment for the work he did as penciler, inker and for gray tones on the first six issues of The Walking Dead comic series, and he receives royalties for the TV show. To assert otherwise is simply incorrect.. The play, a dark cul-de-sac of a comedy, bears witness to that mock Tolstoyan statement, but not without falling victim to fallacies of Mr. Currans own creation, including a melodramatic ending. Walking the Dead, which opened last night at the Circle Repertory Company, is a flawed work that manages to shed humor -- if not a clear light -- on some of the more bizarre recesses of the human psyche. At the outset, the playwright warns theatergoers to be prepared for an outrageous ride, a loop-the-loop about transsexualism and other less radical forms of emotional surgery. The play begins with all the characters facing the audience and jabbering simultaneously about a person who has recently died.
